Objectives and scope of application

ALOER Con­sul­tants attach­es the utmost impor­tance and care to the pro­tec­tion of pri­va­cy and per­son­al data (here­inafter DCP) and to com­pli­ance with the rel­e­vant legal provisions.

ALOER under­takes, with­in the frame­work of its activ­i­ties and in accor­dance with the leg­is­la­tion in force in France (Law No. 78–017 of Jan­u­ary 6, 1978 relat­ing to infor­ma­tion tech­nol­o­gy, files and free­doms (known as the Loi Infor­ma­tique et Lib­ertés) and in Europe (Reg­u­la­tion (EU) 2016/679 of the Euro­pean Par­lia­ment and of the Coun­cil of April 27, 2016. It is the enti­ty that deter­mines the means and pur­pos­es and thus acts as Data Con­troller with­in the mean­ing of the applic­a­ble reg­u­la­tions on the pro­tec­tion of per­son­al data.

The Per­son­al Data Pri­va­cy Pol­i­cy (here­inafter referred to as the Pol­i­cy) cov­ers pro­cess­ing car­ried out in the con­text of :

  • Man­age­ment of the aloer.fr web­site and requests sent via the online forms on this website
  • Recruit­ing future ALOER Con­sul­tants employees
  • Man­ag­ing ALOER Con­sul­tants’ cus­tomers, ser­vice providers and partners

Generalities applicable to all treatments

Each form on the site lim­its the col­lec­tion of per­son­al data to that which is strict­ly nec­es­sary and indi­cates the purpose(s) for which the data is col­lect­ed and the recipient(s) of the data.

The infor­ma­tion required to process your request is indi­cat­ed by an aster­isk on each form. If you do not fill in these manda­to­ry fields, ALOER Con­sul­tants will not be able to respond to your requests and/or pro­vide you with the request­ed ser­vices. Oth­er infor­ma­tion is option­al and enables us to bet­ter man­age your request and improve our com­mu­ni­ca­tions and ser­vices to you.

Sharing data with third parties and transferring your data outside the European Union

We nev­er share your per­son­al data with oth­er com­pa­nies for com­mer­cial prospect­ing purposes.

Each sec­tion ded­i­cat­ed to a pro­cess­ing oper­a­tion details the inter­nal Recip­i­ents who may access and process the data con­cerned. Data may be trans­mit­ted to tech­ni­cal ser­vice providers cho­sen for their exper­tise and reli­a­bil­i­ty, who act on our behalf and in accor­dance with our instruc­tions (IT sub­con­trac­tor, serv­er host, etc.).

We autho­rize these ser­vice providers to use your per­son­al data only to the extent nec­es­sary to per­form ser­vices on our behalf or to com­ply with legal require­ments, and we strive to ensure that your per­son­al data is pro­tect­ed at all times.

ALOER Con­sul­tants may also dis­close your data to third par­ties where such dis­clo­sure is required by law, reg­u­la­tion or court order, or where such dis­clo­sure is nec­es­sary to pro­tect and defend our rights.

All such third par­ties may come from coun­tries with­in or out­side the Euro­pean Union (“EU”), includ­ing coun­tries that do not offer the same lev­el of data pro­tec­tion as your coun­try of residence.

In such a case, the data we col­lect when you use our plat­form or ser­vices is trans­ferred to oth­er coun­tries. This is the case, for exam­ple, if some of our ser­vice providers are locat­ed out­side the Euro­pean Eco­nom­ic Area.

In the event of such a trans­fer, we guar­an­tee that it will be car­ried out :

  • To a coun­try offer­ing an ade­quate lev­el of pro­tec­tion, i.e. a lev­el of pro­tec­tion equiv­a­lent to that required by Euro­pean regulations;
  • With­in the frame­work of stan­dard con­trac­tu­al clauses ;
  • With­in the frame­work of inter­nal com­pa­ny rules.

Data security

ALOER Con­sul­tants is com­mit­ted to pro­tect­ing your per­son­al data against loss, destruc­tion, alter­ation, unau­tho­rized access or dis­clo­sure. To this end, ALOER Con­sul­tants imple­ments appro­pri­ate tech­ni­cal and orga­ni­za­tion­al mea­sures, with regard to the nature of the data and the risks involved in pro­cess­ing it, to pre­serve the secu­ri­ty and con­fi­den­tial­i­ty of your per­son­al data and, in par­tic­u­lar, to pre­vent it from being dis­tort­ed, dam­aged or accessed by unau­tho­rized third parties.

These mea­sures may include prac­tices such as lim­it­ed access to data by per­son­nel autho­rized to access it by virtue of their func­tions, con­trac­tu­al guar­an­tees in the event of recourse to an exter­nal ser­vice provider, pri­va­cy impact assess­ments, reg­u­lar reviews of our pri­va­cy prac­tices and poli­cies and/or phys­i­cal and/or log­i­cal secu­ri­ty mea­sures (secure access, authen­ti­ca­tion pro­ce­dures, back-up copies, antivirus soft­ware, fire­walls, etc.).

Data concerning minors

ALOER Con­sul­tants ser­vices and events are not intend­ed for minors. We do not know­ing­ly col­lect or process per­son­al data relat­ing to minors. In the event that we become aware of the col­lec­tion of per­son­al data from minors with­out the pri­or autho­riza­tion of the legal guardian or parental author­i­ty, we will take appro­pri­ate mea­sures to delete such per­son­al data from our servers.

Processing by ALOER Consultants

Man­age­ment of the ALOER Con­sul­tants web­site and requests sent via online forms

When you browse the ALOER Con­sul­tants web­site, you may be asked to :

  • Fill in a recruit­ment response form ;
  • Fill in a contact/information request for a service ;
  • Down­load doc­u­ments (white papers, train­ing pro­grams, etc.).

With­in the frame­work of this activ­i­ty, and on the basis of your Con­sent which you express when you fill in the form, ALOER Con­sul­tants process­es and stores the fol­low­ing per­son­al data con­cern­ing you:

  • to respond to your con­tact request: the infor­ma­tion pro­vid­ed on the form, i.e. your iden­ti­ty, your con­tact details and, if applic­a­ble, the con­tent of the mes­sage, as well as any infor­ma­tion com­mu­ni­cat­ed sub­se­quent­ly dur­ing our exchanges. These data are processed by the depart­ment con­cerned by your request for the time nec­es­sary to reply.

Depend­ing on your request and the con­tent of our exchanges, data col­lect­ed in this way may be used for oth­er pur­pos­es, such as the man­age­ment of a request for com­mer­cial or train­ing pro­pos­als; such pro­cess­ing is then sub­ject to the rel­e­vant terms and conditions.

We also inform you that we com­pile anony­mous sta­tis­tics on vis­its to the ALOER Con­sul­tants web­site, which do not allow us to iden­ti­fy you.

Pro­cess­ing for the pur­pose of pro­mot­ing Alo­er Con­sul­tants’ ser­vices and events

ALOER Con­sul­tants col­lects and uses the iden­ti­fi­ca­tion data and pro­fes­sion­al con­tact infor­ma­tion of prospects and cus­tomers, includ­ing pub­lic data avail­able on the Inter­net, for the pur­pose of pro­mot­ing ALOER Con­sul­tants’ ser­vices and events.

This Pro­cess­ing is based on ALOER Con­sul­tants’ legit­i­mate inter­est in pro­mot­ing its activ­i­ties to pro­fes­sion­al pro­files like­ly to be inter­est­ed in ALOER Con­sul­tants’ services.

Data is processed and stored for this pur­pose by the ALOER Con­sul­tants sales depart­ment, sub­ject to a request to unsubscribe:

  • for prospects: for 5 years from the last contact;
  • for cus­tomers: for the dura­tion of the com­mer­cial rela­tion­ship, then for 5 years from the end of the com­mer­cial relationship.

In the event of indi­rect col­lec­tion of your data for mar­ket­ing com­mu­ni­ca­tion pur­pos­es, in par­tic­u­lar pub­lic data on the Inter­net, ALOER Con­sul­tants will inform you at the time of the first com­mu­ni­ca­tion, and in any event with­in one month of the col­lec­tion of the data, of the intend­ed use and of your right to object to the pro­cess­ing of your data for mar­ket­ing purposes.

Processing(s) car­ried out to man­age prospects, cus­tomers, ser­vice providers and partners

ALOER Con­sul­tants may also process per­son­al data about you when :

  • make a request for con­sult­ing or train­ing ser­vices, using the online form on the site or direct­ly by tele­phone to the sales department;
  • your com­pa­ny enters into a con­tract with ALOER Con­sul­tants as a cus­tomer, ser­vice provider or partner.

In this con­text, ALOER Con­sul­tants will col­lect infor­ma­tion relat­ing to :

  • to the contact(s) indi­cat­ed at ALOER Con­sul­tants, such as the con­tact indi­cat­ed on the form, the main con­tact for the con­tract, the billing con­tact and any oth­er con­tact per­son: sur­name, first name, pro­fes­sion­al e‑mail address, pro­fes­sion­al tele­phone num­ber, posi­tion, and all infor­ma­tion con­tained in the exchanges (nature of the request, etc.);
  • con­tract signatory(ies): sur­name, first name, posi­tion, signature.

This data is intend­ed, where nec­es­sary, for employ­ees respon­si­ble for mon­i­tor­ing the com­mer­cial rela­tion­ship and/or part­ner­ship, for accounting/billing and for employ­ees in the depart­ments involved in the request/contract.

They are col­lect­ed and stored :

  • for requests for quo­ta­tions that do not lead to the con­clu­sion of a con­tract: the time required to study and fol­low up the request + five (5) years after the request was closed (or the last con­tact, if applicable);
  • to meet our legit­i­mate inter­est in pro­tect­ing and defend­ing our rights in the event of lit­i­ga­tion, for ten (10) years fol­low­ing the end of the con­trac­tu­al relationship.

Your con­tact infor­ma­tion may also be used to send you infor­ma­tion from ALOER Con­sul­tants about ALOER Con­sul­tants ser­vices and events. Pro­cess­ing for recruit­ment purposes

ALOER Con­sul­tants may process per­son­al data about you when you sub­mit an unso­licit­ed appli­ca­tion or when you apply to an adver­tise­ment post­ed by ALOER Con­sul­tants (via third-par­ty sites relay­ing ALOER Con­sul­tants’ recruit­ment advertisements).

In this con­text, per­son­al data con­cern­ing you is collected:

  • direct­ly with you dur­ing the recruit­ment process;
  • indi­rect­ly with third par­ties to check your diplo­mas and ref­er­ences, with your consent.

We col­lect the fol­low­ing data: sur­name, first name, e‑mail address, tele­phone num­ber, pro­fes­sion­al expe­ri­ence, and any oth­er infor­ma­tion you pro­vide when send­ing us your appli­ca­tion and/or cur­ricu­lum vitae and/or inter­views: pho­to, skills, lev­el of edu­ca­tion, lan­guages spo­ken, salary expec­ta­tions, home address, hob­bies, fam­i­ly sit­u­a­tion, etc. We will use this infor­ma­tion to con­tact you as soon as possible.

If you pro­vide us with the con­tact details of a ref­er­ence, it is your respon­si­bil­i­ty to ensure that the ref­er­ence has been informed and has giv­en you their consent.

This data is col­lect­ed and stored sole­ly for the pur­pose of man­ag­ing your appli­ca­tion, on the basis of the legit­i­mate inter­ests of ALOER Con­sul­tants and/or your con­sent, and is not used for any oth­er pur­pose, includ­ing com­mer­cial purposes.

They are kept :

  • in the event of a pos­i­tive out­come to an appli­ca­tion: data relat­ing to an employ­ee is kept for the dura­tion of his/her pres­ence at ALOER Con­sul­tants and after his/her depar­ture for the applic­a­ble legal reten­tion period;
  • in the event of a neg­a­tive out­come to an appli­ca­tion: one (1) year, unless you object.

In all cas­es, your per­son­al data will be delet­ed at your request with­in a max­i­mum of one (1) month from the date of your request.

This data is processed by the employ­ees in charge of recruit­ment at ALOER Con­sul­tants only and, inci­den­tal­ly, for tech­ni­cal and logis­ti­cal rea­sons, by ALOER Con­sul­tants’ subcontractors.

Pro­cess­ing for train­ing man­age­ment purposes

ALOER Con­sul­tants is required to process per­son­al data con­cern­ing you when you reg­is­ter for a train­ing course orga­nized by ALOER Con­sul­tants, via the online reg­is­tra­tion form or by tele­phone with the train­ing department.

In this con­text, ALOER Con­sul­tants will col­lect infor­ma­tion relat­ing to :

  • trainees: sur­name, first name, email and postal address­es, tele­phone num­ber, lev­el of knowl­edge regard­ing per­son­al data;
  • com­pa­ny rep­re­sen­ta­tives (train­ing and finance depart­ments): sur­name, first name, title, email and postal address­es, tele­phone number.

This data is col­lect­ed and processed by the ALOER Con­sul­tants train­ing depart­ment with a view to reg­is­ter­ing trainees for train­ing cours­es cor­re­spond­ing to their lev­el of knowl­edge, send­ing them train­ing mate­ri­als and invoic­ing train­ing services.

It is kept for the dura­tion of the train­ing con­tract and, in order to meet our legit­i­mate inter­est in pro­tect­ing and defend­ing our rights in the event of lit­i­ga­tion, for five (5) years fol­low­ing the end of the con­trac­tu­al relationship.

It is also used by the sales depart­ment to com­mu­ni­cate about ALOER Con­sul­tants’ ser­vices and events, in accor­dance with the con­di­tions set out in the sec­tion enti­tled “Processing(s) car­ried out for the pur­pose of pro­mot­ing ALOER Con­sul­tants’ ser­vices and events”.

Exercising your rights and contacting our Data Protection Officer

In accor­dance with the reg­u­la­tions in force, you have the right to access and rec­ti­fy your per­son­al data, as well as the right to request its dele­tion (the right to be for­got­ten), the right to object to its pro­cess­ing and to obtain its lim­i­ta­tion or porta­bil­i­ty inso­far as this is applic­a­ble, sub­ject to any com­pelling legit­i­mate rea­sons that Alo­er Con­sul­tants may have for keep­ing your data.

With regard to per­son­al data relat­ing to your appli­ca­tion, we invite you to keep your infor­ma­tion up to date by noti­fy­ing ALOER Consultants .

In addi­tion, you can, at any time and with­out jus­ti­fi­ca­tion, ask to no longer receive our infor­ma­tion com­mu­ni­ca­tions and, more gen­er­al­ly, com­mu­ni­ca­tions relat­ing to our ser­vices, news and events by using the hyper­text link pro­vid­ed for this pur­pose in each email we send you.

When you exer­cise your rights, our data pro­tec­tion offi­cer process­es your per­son­al data for the pur­pose of man­ag­ing your request (title, sur­name, first name, nature of request, response). This data is kept for a peri­od of three (3) years.

Appendices — definitions

Con­sent: any free, spe­cif­ic, informed and unam­bigu­ous expres­sion of will by which the data sub­ject accepts, by a dec­la­ra­tion or by a clear pos­i­tive act, that per­son­al data con­cern­ing him or her may be Processed.

Data Pro­tec­tion Offi­cer (or “DPO”): per­son appoint­ed by ALOER Con­sul­tants in charge of the pro­tec­tion of per­son­al data with­in ALOER Con­sul­tants and of ALOER Con­sul­tants’ com­pli­ance with applic­a­ble legislation.

Recip­i­ent: nat­ur­al or legal per­son, pub­lic author­i­ty, depart­ment or any oth­er orga­ni­za­tion that receives per­son­al data, whether or not it is a third party.

Per­son­al data / per­son­al data / data any infor­ma­tion relat­ing to a data sub­ject, in par­tic­u­lar by ref­er­ence to an iden­ti­fi­er such as a name, an iden­ti­fi­ca­tion num­ber, an ID card num­ber, a salary, health records, bank account infor­ma­tion, dri­ving or con­sump­tion habits, loca­tion data, an online iden­ti­fi­er, etc. The term “per­son­al data” includes sen­si­tive per­son­al data.

Sen­si­tive per­son­al data/sensitive per­son­al data : refers to per­son­al data reveal­ing or based on :

  • racial or eth­nic ori­gin, polit­i­cal, reli­gious or philo­soph­i­cal opinions;
  • mem­ber­ship of a trade union ;
  • phys­i­cal or men­tal health;
  • sex­u­al ori­en­ta­tion or sex life;
  • genet­ic and bio­met­ric data ;
  • data relat­ing to crim­i­nal con­vic­tions, offences or relat­ed secu­ri­ty measures.

Applic­a­ble leg­is­la­tion ALOER Con­sul­tants is sub­ject to the fol­low­ing reg­u­la­tions: all reg­u­la­tions relat­ing to the pro­tec­tion of per­son­al data and applic­a­ble to the Pro­cess­ing of per­son­al data car­ried out by ALOER Con­sul­tants, name­ly the Euro­pean reg­u­la­tion n°2016/679 relat­ing to the pro­tec­tion of per­son­al data (RGPD), the amend­ed Loi infor­ma­tique et lib­ertés, and any oth­er relat­ed reg­u­la­tions applic­a­ble to ALOER Consultants.

Data subject/person : the nat­ur­al per­son to whom the per­son­al data relates and who can be iden­ti­fied or iden­ti­fi­able, direct­ly or indi­rect­ly, thanks to this per­son­al data. This includes past and present cus­tomers, prospects and employees.

Data con­troller : nat­ur­al or legal per­son who, indi­vid­u­al­ly or joint­ly, decides what per­son­al data is col­lect­ed, why and how it is col­lect­ed and processed.

RGPD: abbre­vi­a­tion for Euro­pean Reg­u­la­tion No. 2016/679 of April 27, 2016 on the pro­tec­tion of indi­vid­u­als with regard to the pro­cess­ing of per­son­al data and on the free move­ment of such data.

Sub­con­trac­tor: any nat­ur­al or legal per­son, pub­lic author­i­ty, depart­ment or oth­er body that process­es per­son­al data on behalf of the con­troller and in accor­dance with its instruc­tions (e.g. ser­vice providers or suppliers).

Third par­ty: any nat­ur­al or legal per­son, pub­lic author­i­ty, agency or any oth­er body oth­er than the data sub­ject, the Data Con­troller, the Sub­con­trac­tor and per­sons who, under the direct author­i­ty of the Data Con­troller or Sub­con­trac­tor, are empow­ered or autho­rized to process the data.

Treat­ment pro­cess­ing: any oper­a­tion or set of oper­a­tions per­formed on per­son­al data, whether or not by auto­mat­ed means, such as col­lect­ing, access­ing, record­ing, copy­ing, trans­fer­ring, keep­ing, stor­ing, cross-ref­er­enc­ing, mod­i­fy­ing, struc­tur­ing, mak­ing avail­able, com­mu­ni­cat­ing, record­ing or destroy­ing, whether auto­mat­i­cal­ly, semi-auto­mat­i­cal­ly or oth­er­wise. This list is not exhaustive.

Data trans­fer Trans­fer: any com­mu­ni­ca­tion, copy­ing or mov­ing of data over a net­work, or any com­mu­ni­ca­tion, copy­ing or mov­ing of such data from one medi­um to anoth­er, irre­spec­tive of the medi­um, of per­son­al data to a coun­try out­side the Euro­pean Union or to an inter­na­tion­al orga­ni­za­tion which is or is intend­ed to be processed after such Transfer.
